Published in Government Gazette Issue 125/A/4 August 2026, Law No. 5326/2026 of the Ministry of Justice introduces, through Article 61, a new and fully standardized procedure for the recognition of ownership through adverse possession (usucaption) for properties whose owners are recorded as “unknown” in the Hellenic Cadastre.According to POMIDA, the main change introduced by the new procedure is the mandatory involvement of cadastral mediation, particularly in cases where public authorities are also involved.Cadastral mediation is now a mandatory prerequisite for the hearing of legal actions seeking recognition of ownership. If the mediation procedure is not completed, the relevant claims will be dismissed as inadmissible. The new framework aims to standardize the procedure for correcting cadastral records concerning properties registered as “unknown owner” and to provide property owners and possessors with a clearer process for establishing and officially recognizing their ownership rights.
The Plenary of the Council of State (Supreme Administrative Court) addressed the constitutionality of Article 110(3)(a) and (b) of Law 4495/2017, which allow the regularization of unauthorized buildings where the relevant building permits have been annulled by a court due to the application of an invalid or erroneous planning and zoning framework, provided that the property owners were not responsible for any false or inaccurate information submitted during the issuance of the permits.
Considered one of the most ambitious legislative codification projects in Greece, the new Spatial Planning and Urban Development Code has been approved by the Plenary Session of the Greek Parliament.
